Terms of Service

Welcome to Pinfly. These Terms of Service ("Terms") govern your use of the Pinfly platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using Pinfly, you confirm that you are at least 18 years old and agree to comply with these Terms. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms. Your acceptance is recorded against your account with a timestamp and the version of these Terms in effect at the time; if these Terms are materially updated after you registered, you will be asked to review and re-accept them before continuing to use the Service.
2. Account Registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
3. Creator Obligations
As a Creator, you agree to: (a) complete missions honestly and in compliance with the stated requirements; (b) submit only original, authentic content that you have the right to share; (c) not use bots, fake accounts, or fraudulent methods to inflate engagement; (d) comply with all applicable platform guidelines (TikTok, Instagram); (e) clearly disclose any paid partnership or advertising relationship arising from a mission, using the platform's native paid-partnership tag and/or a clear in-caption disclosure, in compliance with applicable advertising law (including the FTC Endorsement Guides, EU/ASA rules, and the French *loi influenceurs* of 2023). Campaigns with additional requirements (draft approval, gifted products, exclusivity, or other bespoke terms) are governed by the specific campaign agreement you accept when invited to that campaign, in addition to these Terms.
4. Brand Obligations
As a Brand, you agree to: (a) provide accurate campaign descriptions and requirements; (b) fund campaigns before activation; (c) not request content that violates any laws or platform policies; (d) respect creators' intellectual property rights as specified in the campaign terms.
5. Payments & Rewards
Pinfly facilitates payments between Brands and Creators. Rewards are distributed after content verification. A Creator will always receive at least the reward amount advertised on a mission, and may receive more: Pinfly maintains a creator score and tier based on reach, reliability, and engagement, and higher tiers receive a payout bonus on top of the advertised reward for the same mission. Pinfly charges a platform commission on campaign budgets, computed on the amount actually paid to the Creator. Payment timelines are subject to verification and processing times. Pinfly reserves the right to withhold payments in cases of suspected fraud.
6. Content & Intellectual Property
Creators retain ownership of their content. By submitting content through Pinfly, Creators grant the commissioning Brand a license to use the content as specified in the campaign terms. Pinfly does not claim ownership of Creator content but reserves the right to display submissions within the platform.
7. Prohibited Conduct
You may not: (a) violate any laws or regulations; (b) impersonate others; (c) submit false or misleading content; (d) manipulate engagement metrics; (e) attempt to circumvent the platform to deal directly with parties discovered through Pinfly; (f) reverse engineer or attempt to access non-public areas of the Service.
8. Termination
We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Pending verified rewards will still be paid out, but unverified or disputed submissions may be forfeited.
9. Limitation of Liability
Pinfly is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Pinfly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via email or through the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.
